Terms of Service

1. Agreement to Terms

By accessing or using Split Circle, you agree to be bound by these Terms of Service. If you disagree, don't use the Service.

These Terms constitute a legally binding agreement between you and Split Circle.

2. Service Description

Split Circle helps users:

• Split expenses among groups
• Track who owes whom
• Generate UPI payment links
• Manage shared expenses

IMPORTANT: Split Circle is NOT a payment processor. We only track expenses and generate UPI links. All payments occur through third-party UPI apps.

3. Eligibility

To use Split Circle, you must:

• Be at least 13 years old (16 in EEA)
• Have legal capacity to enter binding contracts
• Not be prohibited from using the Service
• Provide accurate information

4. Account Registration and Security

4.1 Account Creation

Create an account with a valid phone number, name, and optional email/photo. You may also use Google or Apple Sign-In.

4.2 Your Responsibilities

You're responsible for:

• Keeping your account secure
• All activities under your account
• Notifying us of unauthorized access
• Providing accurate information

4.3 Account Termination

We may suspend/terminate your account if you:

• Violate these Terms
• Engage in fraudulent activities
• Have been inactive for 2+ years

5. Use of the Service

5.1 Permitted Use

You may use Split Circle to track and split expenses, create circles, and generate UPI payment links.

5.2 Prohibited Use

You must NOT:

• Use the Service illegally
• Defraud or scam other users
• Harass or abuse others
• Upload malware or viruses
• Attempt to hack or reverse engineer
• Scrape data with automated tools
• Create fake expenses
• Impersonate other users

5.3 User Content

You're responsible for all content you post (expenses, photos, messages). You grant us a license to use your content for operating the Service.

6. Payments and UPI Integration

6.1 UPI Links

When you generate a UPI link:

• We create a link with payment details
• The link opens your UPI app
• You complete payment in the UPI app
• We do NOT receive or process the payment

6.2 Payment Disputes

Split Circle is NOT responsible for:

• Failed payments
• Incorrect amounts
• Payment disputes between users
• Fraud or scams

Resolve payment disputes directly with other users. We cannot reverse payments.

7. Circles and Group Expenses

As a circle creator, you're the admin and responsible for the circle's content.

When inviting users:

• Don't spam invitations
• Only invite people who've agreed
• Don't add expenses without their knowledge

Settle all debts before deleting a circle or removing members.

8. Intellectual Property

Split Circle and its content are owned by us and protected by intellectual property laws.

You may NOT:

• Copy or modify our app
• Use our trademarks or branding
• Create derivative works

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

10. Third-Party Services

We integrate with:

• OAuth: Google Sign-In, Apple Sign-In
• UPI Apps: Google Pay, PhonePe, Paytm, BHIM, etc.
• Messaging: WhatsApp, SMS

Your use of these services is subject to their own terms. We're not responsible for their practices.

11. Disclaimers and Limitations

11.1 Service Availability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties.

We do NOT warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• Results will be accurate

11.2 Limitation of Liability

To the maximum extent permitted by law, Split Circle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Maximum Liability: Our total liability shall not exceed the greater of the amount you paid us in the past 12 months or $100 USD.

12. Indemnification

You agree to indemnify Split Circle from claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of others' rights
• Your content or conduct
• Your payment disputes

13. Dispute Resolution

Governing Law: These Terms are governed by the laws of India.

Arbitration: Disputes shall be resolved through good-faith negotiation, then binding arbitration.

Class Action Waiver: You waive the right to participate in class actions.

14. Changes to Terms

We may modify these Terms. We'll notify you of material changes via in-app notice, email, or push notification.

Continued use after changes means you accept the modified Terms.

15. Termination

By You: Delete your account anytime in Settings.

By Us: We may terminate for violations, fraud, or inactivity.

Effect: Upon termination, access is revoked and data deleted per our Privacy Policy. Outstanding debts are NOT automatically settled.
